Article 2 - Purpose
The general conditions of sale detailed below apply to the products and services ordered via this site.

The products governed by the General Conditions are those which appear on the Website and which are indicated as sold and shipped by KADISHA (the "Products").
Article 4 - Price
The prices of our products are indicated in euros, all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs.
The amount of processing and shipping costs will be specified before validation of the order.
In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of KADISHA. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country. We advise you to inquire about these aspects with your local authorities.
All orders, whatever their origin, are payable in euros. Any costs for currency exchange and international payments are the responsibility of the buyer.
KADISHA reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price in force at the time of validation of the order and subject to availability.
The products remain the property of KADISHA until full payment of the price.
Please note: as soon as you take physical possession of the products ordered, the risk of loss or damage to the products is transferred to you.
Article 5 - Orders
The contractual information is presented in French and will be confirmed at the latest when your order is validated.
KADISHA reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.
Any order will be validated only after acceptance of payment.
Orders are definitively accepted within the limit of available stocks. The unavailability of a product does not engage the responsibility of KADISHA and does not entitle the customer to compensation or damages.
After validation of the order by KADISHA, the customer receives a confirmation by e-mail.
The customer accepts the use of electronic mail within the framework of the order confirmation.
Article 6 - Validation of your order
Any order appearing on the Website implies acceptance of the General Conditions. Any order confirmation entails your full and entire adherence to the General Terms and Conditions of Sale, without exception or reservation.
All the data provided and the recorded confirmation will constitute proof of the transaction.
You declare that you have fully understood it.
The order confirmation will constitute signature and acceptance of the operations carried out.
Article 7 - Payment
The fact of validating your order implies for you the obligation to pay the indicated price.
The prices of the products sold on the site are indicated by article and reference and are mentioned in euros. The prices are inclusive of all French taxes (French VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs.
The applicable prices are the prices displayed on the site at the time of the order. It is specified that the seller may, if he wishes, modify the prices of the products at any time, without notice.
In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be eligible. The customer is solely responsible for checking the possibilities of importing the products ordered with regard to the rights of the territory of the country of delivery.
The methods of payment accepted on our site are the following credit/debit cards and Paypal​.
The customer expressly acknowledges that the communication of his credit card number to KADISHA constitutes authorization to debit his account with reference to the price of the products ordered.
If necessary, a notification of cancellation of order for non-payment is sent to the customer by KADISHA on the email address communicated by the customer when creating his account on the site. Any bank charges in the event of non-payment remain the responsibility of the buyer.
Article 8 - Withdrawal
In accordance with article L.221-18 of the French Consumer Code, the customer has a withdrawal period of 14 clear days from the date of receipt of his order to exercise his right of withdrawal. legal.
The customer can return one or more items from the said order to KADISHA.
The return of products is the responsibility of the customer and is at his own risk.
The customer acknowledges that additional customs fees related to the return of a product from abroad may be borne by the customer.
KADISHA recommends being vigilant about tracking the return package and encourages the customer to keep solid proof of shipment (preferably with tracking). The customer can choose the carrier of his choice. KADISHA does not accept parcels or letters sent to it postage due.
Items returned by the customer must be new, unworn, unused or having been subject to any use whatsoever. Items must be returned in sturdy, protective packaging along with a copy of the invoice.
If the item is returned in non-protective packaging and is damaged KADISHA will not issue a refund.
Failure to comply with these return conditions, the package will be returned to the customer at his expense and will not result in any refund.
Upon receipt of the return of the order, KADISHA will issue a refund, excluding the initial shipping costs (within 15 days).
The customer must indicate by email to kadisha@kadisha.fr the reasons for the return.
Unless otherwise indicated by the customer, the refund will be made using the same means of payment as that used for payment of the initial order.
It is not possible to replace or exchange returned products. You will need to place a new order.
Return costs are the responsibility of KADISHA if the product delivered to the customer is different from the product ordered.

Article 9- Availability
Our products are offered as long as they are visible on the Website and within the limits of available stocks.
In case of unavailability of product after placing your order, we will notify you by email. Your order will be automatically canceled and no bank debit will be made.
Article 10 - Delivery
The products ordered on the KADISHA site are delivered within the deadlines indicated on the site at the time of the order confirmation. These times are given for information only and correspond to the average processing and delivery time of the package.
It is up to the customer to check the condition of the package at the time of delivery and to make any justified complaints if the package is likely to have been damaged. Any open or incomplete package should not be accepted by the customer. Write down your reservations with precision to be entered on the delivery note.
KADISHA delivers orders within a maximum of 7 working days in Metropolitan France and a maximum of 15 working days for international markets, excluding weekends and public holidays. This delivery time is counted from the day after the validation of the order.
The day after our new products are put online or during the Christmas period, the delivery time can be extended by 10 days so that KADISHA can have the time necessary to prepare your orders.
Any change of address by the customer after validation of an order will result in a delay in delivery, which the customer acknowledges and accepts.

KADISHA and the carriers being separate and independent entities, KADISHA cannot be held responsible for any delay and error in delivery or loss of parcels attributable to LA POSTE.
The delivery is the responsibility of the customer and according to the tariffs of the carriers in force and proposed by the site at the time of the purchase if the place of delivery is not in the aforementioned country/countries.

Article 11 - Warranty
The products offered by KADISHA benefit from the legal guarantees of conformity and hidden defects.
Non-compliant use of the products and the related consequences do not fall within the scope of the contractual guarantees. KADISHA's liability is limited to the purchase price of products purchased on the site.
Independently of the legal guarantee of conformity, KADISHA offers a commercial guarantee specified below:
KADISHA takes great care over the quality of its products and offers a commercial guarantee valid for 1 year following the purchase.
The warranty only applies if use of the product is judged by KADISHA to be normal.
The commercial guarantee does not apply in the context of aging, alteration due to the use of a perfume, cream or any other product which would deteriorate the jewel, wear, breakage or loss. following an accidental cause, the intervention of a third party, improper use, lack of maintenance or finally damage caused during transport engaging the responsibility of the carrier.
After verification of the product and the validity of the guarantee, the guarantee includes the free repair of the product within the limits of the parts available. If the product cannot be repaired, KADISHA will exchange the product (subject to available stocks) or issue a credit note for a product of similar value.
This guarantee is exercised subject to presentation by the customer of the purchase invoice.
Article 12 - Liability
The products offered comply with the French legislation in force. KADISHA cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is up to you to check with the local authorities the possibilities of importing or using the products or services that you plan to order.
Furthermore, KADISHA cannot be held liable for damage resulting from improper use or poor maintenance of the purchased product.
KADISHA cannot be held liable in the event that the non-performance of its obligations is attributable either to the unforeseeable and insurmountable event of a third party to the contract or to a case of force majeure as defined by French case law. Similarly, KADISHA cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, external intrusion or the presence of computer viruses.
Article 13 - Applicable law in the event of disputes and jurisdiction
The language of this contract is French. The General Conditions are subject to French law to the exclusion of the rules of private international law. In the event of a dispute, the French courts will have sole jurisdiction and the competent court will be that of the place of residence of the defendant or, at the choice of the plaintiff, of the place of actual delivery of the Product.
The Website complies with French legislation, and under no circumstances does KADISHA give any guarantee of compliance with the local legislation that would be applicable to you, when you access the Website from other countries.
